Terms of Use for Real Estate Information Websites

These Terms and Conditions define the rights and obligations between J Home 2u (the operator) (hereinafter referred to as "we") and real estate companies (hereinafter referred to as "registered companies") that use the real estate information website "J Home 2 U" (hereinafter referred to as "this site") operated by us. Registered companies shall use this site after agreeing to these Terms and Conditions.

Article 1 (Application)
1. These Terms and Conditions apply to all relationships between us and registered companies regarding the use of this site.
2. Any rules, guidelines, etc. related to these Terms of Service posted on this website (hereinafter referred to as "Individual Provisions") shall constitute a part of these Terms of Service.
3. In the event of any conflict between the content of these Terms and Conditions and the individual provisions of the preceding paragraph or other descriptions of this website outside of these Terms and Conditions, the provisions of these Terms and Conditions shall prevail unless otherwise stipulated in the individual provisions, etc.

Article 2 (Definition)
The meanings of the terms used in these Terms and Conditions are as follows:
(1) "This service" refers to the real estate buying and selling information posting and matching service that we provide through this website.
(2) "Registered Company" means a real estate broker who has agreed to these Terms and Conditions and has registered to use the service in the manner prescribed by us.
(3) "User" means any person other than the registered company who browses this site or uses this service (e.g., prospective buyers).
(4) "Contract concluded" means that a real estate sales contract or other similar contract is concluded between the registered company and the user through the information posted on this site.

Article 3 (User Registration)
1. Anyone wishing to use this service must agree to the terms and conditions of this agreement and apply for registration using the method specified by us.
2. We may refuse to approve an application for user registration if we determine that the applicant falls under any of the following circumstances, and we are under no obligation to disclose the reasons for such refusal.
(1) When you do not have a real estate brokerage license
(2) When there are false statements, errors, or omissions in the registration information.
(3) If you have previously had your registration revoked due to a violation of these Terms and Conditions or other reasons.
(4) When we determine that the person is an anti-social force (gang, gang member, or other similar person)
(5) In any other case where we determine that the user registration is inappropriate.

Article 4 (Changes to Registered Information)
If any changes occur to the registered information, the registered company shall promptly notify us of the changes using the method prescribed by us.

Article 5 (Account Management)
1. Registered companies shall be responsible for properly managing their IDs, passwords, etc., related to this service.
2. Registered companies may not, under any circumstances, transfer, lend, or share their ID and password with any third party.
3. The registered company shall be responsible for any damages resulting from insufficient management of IDs and passwords, errors in use, use by third parties, etc., and we shall not be held liable in any way.

Article 6 (Obligation to report on concluded agreements)
1. If a registered company concludes a contract with a user through the information posted on this site, it shall report this fact to us without delay using the method prescribed by us.
2. The report mentioned in the preceding paragraph shall include the date of the agreement, property information, and other matters as determined by us.
3. If a registered company fails to make the reports described in the preceding two paragraphs without justifiable reason, or makes false reports, we may cancel the registered company's registration or restrict its use of the Service.

Article 7 (Prohibited matters)
Registered companies must not engage in any of the following acts when using this service:
(1) Acts that violate laws or public order and morals
(2) Posting false or misleading property information
(3) Any act that infringes upon the intellectual property rights, portrait rights, privacy, reputation, or other rights or interests of us or a third party.
(4) Falsely claiming that a contract concluded without using this site was concluded through this site, or avoiding reporting as required in the preceding article regarding contracts concluded through this site.
(5) Any act of unauthorized access to our system or interference with its operation.
(6) Acts of providing benefits to antisocial forces, etc.
(7) Any other conduct that we deem inappropriate

Article 8 (Disclaimer)
1. We are not a party to any real estate sales contracts or other agreements concluded between registered companies and users through this site, and we shall not be liable for the content of such contracts, their performance, or any disputes arising between registered companies and users as a result thereof.
2. Any disputes referred to in the preceding paragraph shall be resolved between the registered company and the user at their own responsibility and expense, and we shall have no obligation to participate in their resolution.
3. We do not guarantee the accuracy, completeness, or usefulness of the property information posted on this website.
4. We shall not be liable for any damages incurred by the registered company as a result of this service, except in cases of our willful misconduct or gross negligence. Even if we are liable for damages, our liability shall be limited to the amount of the usage fees paid by the registered company to us for the use of this service that directly caused the damage.

Article 9 (Usage Fees)
1. Basic use of this service (such as listing property information) is free of charge.
2. There are no fees for listing properties or for commissioning successful transactions. Everything is free.
3. Transactions concluded through this website are no different from the real estate sales conducted by registered companies as usual, and we have no involvement whatsoever in the relationship with the buyer. Whether or not to charge the buyer a commission or other consideration, and the amount thereof, is at the discretion and responsibility of the registered company, just as in normal real estate transactions. We will not charge the user (seller or buyer) the success fee stipulated in this clause.
4. If we change the fee structure under this clause, we will notify registered companies by posting a notice on this website or by any other method we deem appropriate at least 30 days before the effective date. Registered companies that do not cancel their user registration after the notification in the preceding paragraph and before the effective date will be deemed to have agreed to the revised fee structure.

Article 10 (Intellectual Property Rights)
All intellectual property rights relating to the text, images, and other content published on this site (excluding property information posted by registered companies) belong to us or to third parties who hold legitimate rights.

Article 11 (Handling of Users' Personal Information)
Registered companies shall not use the names, contact information, and other personal information of users (buyers, etc.) obtained through this site for any purpose other than real estate transactions with said users. However, this shall not apply in any of the following cases:
(1) When required by law
(2) When it is necessary to provide information to a third party such as a judicial scrivener, financial institution, or administrative agency in order to carry out registration procedures or other real estate transactions.
(3) When the person's consent has been obtained

Article 12 (Restrictions on Use and Deregistration)
We may, without prior notice, restrict the use of this service or cancel the registration of a registered company if the registered company falls under any of the following categories.
(1) If you violate any provision of these Terms and Conditions
(2) If it is discovered that there are false facts in the registration information
(3) If the real estate brokerage license is revoked or becomes invalid
(4) In any other case in which we determine that the use of this service is inappropriate.

Article 13 (Suspension, Modification, and Termination of the Service)
We reserve the right to change the content of this service, or to suspend or terminate its provision, at our discretion and without prior notice to the registered company. We shall not be liable for any damages incurred by the registered company as a result.

Article 14 (Amendment of these Terms and Conditions)
1. We reserve the right to modify these Terms and Conditions if we deem it necessary.
2. If we amend these Terms and Conditions, we will notify you of the amended content and effective date by posting it on this website or by any other method we deem appropriate at least 30 days before the effective date.
3. If a registered company uses this service after the effective date specified in the preceding paragraph, the registered company will be deemed to have agreed to the revised terms and conditions. However, the revised terms and conditions will not apply to registered companies that have canceled their user registration before the effective date.
4. Matters arising before the amendment of these Terms and Conditions (including contracts already concluded and the handling of success fees therefor) shall continue to be governed by the previous rules.

Article 15 (Governing Law and Jurisdiction)
1. Japanese law shall govern the interpretation of these Terms and Conditions.
2. In the event of any dispute between us and a registered company regarding this service, the Osaka District Court shall be the exclusive court of first instance with agreed jurisdiction.

Supplementary Provisions
These terms and conditions will come into effect on November 1, 2025.
